1. General

1.1 MediYoga Online Sweden AB provides on https://mediyoga.app, or on another website or application designated by MediYoga Online (the “Website”) a subscription-based online service with the content that is available at any time on the Website or in the App (the Service) ”).

1.2 These Terms of Use (the “Terms of Use”) apply to agreements between MediYoga Online and the natural person (the “User”) regarding the Service. Only natural persons who are at least 18 years of age may enter into an agreement with MediYoga Online regarding the Service. MediYoga Online may, after entering into an agreement, provided that statutory conditions for this are met, make a customary credit check and, based on the result of such, withdraw from the agreement with the User. MediYoga Online also has the right to refuse to enter into an agreement or immediately terminate an agreement entered into with a User if the User has previously violated MediYoga Online’s agreement terms. MediYoga Online may, instead of refusing to enter into or terminate an agreement entered into, choose to require the User to provide security for its obligations under the agreement. MediYoga Online also reserves the right to request credit information, or obtain other information about the User, after the conclusion of the agreement in accordance with the Personal Data Policy.

1.3 These Terms of Use and the Personal Data Policy (together with the “Terms”) apply to and are legally binding on MediYoga Online and the User. For agreements, the special conditions (including any special offers) regarding prices, payment time and payment method, agreement time and others that MediYoga Online offers from time to time in connection with the User signing an agreement with MediYoga Online also apply. In the event of a deviation between special conditions and the Terms, the special conditions take precedence. The terms and the special terms together constitute the agreement that applies between the User and MediYoga Online (the “Agreement”). In order to access the Service, the User must confirm that the User has read and accepted the Agreement.

1.4 Once the Agreement has been entered into, MediYoga Online will send a confirmation of this to the e-mail address provided by the User when registering the user account in accordance with point 4 below.

2 Scope of the service
Content
2.1 Immediately after the User has ordered the Service and accepted this Agreement, the User will have access to the content that is provided at any time on the Website or in the App. MediYoga Online is constantly working to improve the User’s viewing experience. The Service and its content may therefore in the future from time to time be replaced, changed (eg by making content on the Website or in the App also available offline on the User’s device (see point 5 below) for a certain period), or updated. Changing, changing or updating the content of the Service and changes in what the Website or the App otherwise looks like shall not be considered to constitute a change to the Agreement or the Service.

Subscription
2.2 For a monthly fee, the User may subscribe and have access to the entire content of the Service.

2.3 MediYoga Online may also offer advance payment of the Service for a certain period, which exceeds one calendar month, and the subscription will then automatically terminate after this period unless the User pays a new advance payment (“Limited Time Subscription”).

2.4 MediYoga Online may offer free use of the Service for a limited period in accordance with the detailed terms set out in the offer (“Test Period”). During the Test Period, the User may at any time choose to terminate the Service without having to pay for the Service. The test period may only be used if the following conditions are met:

(1) The User has not previously been a User and has used the Service for the past six (6) months; and
(2) The user, or any other member of the same household, has not previously taken advantage of a Test Period or any similar marketing offer.

3 Use of the Service
In order to use the Service, the User must register a user account on the Website or in the App (see also point 4), have access to equipment, systems and connection in accordance with these Terms of Use (see also point 5) and, after a possible Test Period expired, make payment in accordance with these Terms of Use (see also point 6). Furthermore, certain technical protection measures have been introduced to prevent unauthorized use of the Service, such as copying, use outside the Territory and redistribution of the content of the Service.

4 Registration, username and password
4.1 Registration of a user account can either take place on the Website, in the App or via other services and social media, as MediYoga Online deems appropriate from time to time. When registering via other services and social media, the User’s user data may be retrieved from such services or social media to create the User’s user end account at MediYoga Online.

4.2 The user is responsible for ensuring that the information provided during registration is correct, including information obtained from other services and social media, and updating his user account with the correct information if necessary. When registering, the User may only provide payment and credit cards held by the User himself.

4.3 When registering, the User must enter a username (e-mail address) and a password (“Login Information”). The user’s Login Information is personal and may not be used by anyone else. The user must store their Login Information so that they are protected from unauthorized access. The User is responsible for all use of the Service that takes place through the User’s user account.

4.4 If the User suspects that unauthorized use is made of his Login Information, the User must notify MediYoga Online as soon as possible, and change the password. If MediYoga Online has reason to believe that the Login Information has been disclosed or otherwise misused by an unauthorized person, MediYoga Online has the right to terminate the Agreement immediately in accordance with clause 14.5 (c).

4.5 MediYoga Online has the right to request the User to change his password at any time. Changes must be made promptly and may cause temporary interruptions in the use of the Service.

5 Equipment etc.
5.1 In order to take part in the Service, the User must have the necessary and approved systems, connections and equipment.

5.2 Specification of system requirements is available on the Website. Compliance with these system requirements does not, however, guarantee that the User can use the Service. In order to use the Service, it may be required that certain third-party software needs to be installed by the User. MediYoga Online will inform the Website about which third party software can be used, but shall in no case be responsible for third party software.

5.3 The Service requires the User to have access to the required Internet connection. The User is responsible for all costs regarding such connection, including costs for data traffic, regardless of where in the Territory (see section 2.1 above) that the User uses the Service. Specification of requirements for the minimum download speed to be able to use the Service is available on the Website or in the App.

5.4 Only the types of equipment listed on the Website may be used and registered for the Service. MediYoga Online has the right, from time to time, to freely decide which equipment is to be considered approved. MediYoga Online takes no responsibility for the performance of approved equipment or its compatibility with the Service.

5.5 MediYoga Online is not responsible for the User not being able to use the Service, or for restricting access to the Service, due to congestion on the Internet or due to errors or problems relating to computers or other devices, networks, electronics or communications.

6 Fees and payment
6.1 Fees for the Service are paid in accordance with the price list in force at any given time, which is available on the Website or in the App.

6.2 Payment of the subscription fee for the next month is made in advance on the day of each month that corresponds to the date when the User entered into an Agreement on the Service. If the user was entitled to use a Test Period, however, no payment shall be made until the first day after the end of the Test Period, see also section 6.4. If MediYoga Online offers a Time-Limited Subscription, and the User chooses to subscribe to one, the User shall pay a subscription fee in advance for the entire relevant time period, see also section 6.4.

6.3 The user chooses to pay the specified fee through one of the means of payment offered by MediYoga Online on the Website or in the App. The User undertakes to sign the necessary documents and, at each payment date, keep sufficient funds for payment of the Service available via the chosen means of payment.

6.4 If the User has received a Test Period, no payment shall be made for the period that the Test Period constitutes.

6.5 If means of payment are not kept available by the User on the date of payment, MediYoga Online will when paying by credit or debit card, again try to deduct the fee from the credit or debit card provided by the User. If payment of the fee has not been made fifteen (15) days from the day the fee should have been paid, MediYoga Online has the right to issue an invoice for the current period, with an additional invoicing fee or deduct the unpaid fee in connection with a regular payment. for next month.

6.6 In the event of late payment, MediYoga Online is also entitled to charge interest on arrears on the amount due in accordance with applicable law, statutory reminder fee and, where applicable, a collection fee.

6.7 In the event of late payment, MediYoga Online also has the right to suspend or restrict the User’s access to the Service. MediYoga Online also has the right to terminate the Agreement with immediate effect in the event of late payment by more than twenty (20) days and at the same time issue a final invoice for all unpaid fees with an additional invoicing fee plus statutory interest.

6.8 When paying with an invoice (if MediYoga Online offers this option), the User may pay a supplement for a paper invoice according to the price list in force at any given time. The invoice due date occurs on the last weekday of the month. Payment is considered completed when it is received by MediYoga Online.

6.9 Payment & cost

Payments and Renewal:

  • Payment will be charged to iTunes Account at confirmation of purchase. Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.
  • Account will be charged for renewal within 24-hours prior to the end of the current period.
  • You can manage or turn off auto-renew in your Account settings at any time after purchase
  • No cancellation of the current subscription is allowed during the active period.

7 Use of the Service
7.1 The User may only use the Service for his own use and in accordance with these Terms of Use. The user must not himself, nor encourage, facilitate for another or allow another:

(a) use the Service for any commercial or public purpose;
(b) use the Service for any illegal or inappropriate purpose;
(c) copy / reproduce, lend, sell, transmit, distribute, edit or otherwise transmit or adapt content from the Service;
(d) circumvent, modify, remove, alter or otherwise manipulate any security, encryption, or other technology or software that is part of the Service; or
(e) otherwise use the Service in violation of copyright or other law.

7.2 The Service may only be used within the Territory. The User may not in any way, nor encourage, facilitate for another or allow another, use or attempt to use the Service outside the Territory.

7.3 Use of the Service in violation of this section 7 shall always be regarded as a material breach of contract, which may result in MediYoga Online terminating the Service with immediate effect (see also section 14).

8 Minors
8.1 The service is not intended for use by children without the involvement, indulgence and consent of parents or guardians. A parent or guardian who allows children to use the Service is solely responsible for assessing whether the content of the Service is suitable for the child.

9 Social media
9.1 MediYoga Online may allow Users to make parts of their user account available on social media such as Facebook and Twitter. If the User chooses to use this function, it may be possible for the public and other Users to see parts of the User’s user account regarding the Service, including what the User looks at for material via the Service. The user agrees that such content will be available to the public and that MediYoga Online is not responsible for the content when it is available on social media.

9.2 If the User uses social media in connection with the Service, the User may not use social media in any way that can be considered insulting, offensive, harassing, obscene, discriminatory or otherwise inappropriate or illegal.

10 User Forum
10.1 MediYoga Online may allow Users to upload their own material on the Website or in the App, such as reviews of content in the Service (“Material”). By posting material on the Website or in the App, the User agrees that the Material will be available to the public and other Users.

10.2 The material may not:

(a) have content that is protected by copyright, trademark or other intellectual property rights without the express consent of the copyright holder;
(b) market any product, service or enterprise;
(c) identify any person without the person’s express consent (by, for example, name, address, image or video), or
(d) be offensive, offensive, harassing, obscene, pornographic, discriminatory or otherwise inappropriate or illegal.

10.3 The user is responsible for any damage that may be caused to MediYoga Online due to the Materials being made available in violation of section 10.2.

10.4 The User agrees that MediYoga Online may review the content of the User’s Materials and remove Materials at its sole discretion.

10.5 The User understands that statements and opinions expressed in Materials are made by other Users, that MediYoga Online does not support such statements and opinions and that such statements and opinions may be incorrect or misleading.

10.6 MediYoga Online has the right to use Materials for marketing purposes itself or through other free of charge to market MediYoga Online, the Service or its content as well as services or products offered by other parties with whom MediYoga Online cooperates. By posting material on the Website or in the App, the User agrees to such use.

11 Changes
11.1 MediYoga Online reserves the right to change the fees and other terms for the Service. Changes must be notified to the User no later than thirty (30) days before the change takes effect. In the event of such a change, the User has the right to terminate the subscription until the date on which the change takes effect. Users who have not cancelled the subscription before the change took effect, shall be deemed to have accepted the change. Changes that are for the obvious benefit of the User apply immediately without the right of termination for the User.

11.2 About prematurity

termination takes place in accordance with this section 11 and the User has paid for the period after the termination of the subscription, MediYoga Online will refund such amount within thirty (30) days from the termination of the subscription.

12 Waiver of right of withdrawal
By entering into the Agreement, the User agrees that the Service is delivered directly and that the content on the Website and in the App is immediately made available to the User. The User also agrees that there is no right of withdrawal for the Service or the Agreement in accordance with the Act (2005: 59) on distance contracts and agreements outside business premises when delivery of the Service has begun. If, after entering into the Agreement and delivery of the Service, the User no longer wishes to use the Service and is no longer bound by the Agreement, the User must therefore terminate the Agreement in accordance with clause 14 below.

13 Information for customers
13.1 MediYoga Online may send messages to the User by e-mail, text message, letter, invoice or publication on the Website or in the App. Messages to the User shall be deemed to have been received by him immediately upon notification via e-mail, text message and publication on the Website or in the App. Notice sent via letter and invoice shall be deemed to have reached the User three (3) days after the letter or invoice has been sent.

13.2 MediYoga Online shall be deemed to have fulfilled its notification obligation by sending a message to the most recently provided e-mail address, telephone number or address, even if these are no longer used by the User or are otherwise unusable.

14 Contract period and termination
14.1 Subscriptions for the Service are subscribed for a subscription period and are automatically extended until the User or MediYoga Online terminates the subscription in accordance with these Terms. No refund of a subscription fee paid in advance for a future period will occur and the User has the right to continue using the Service until the period has expired. If the User is entitled to a Test Period in accordance with section 2.5, the subscription period applies from the day after the Test Period ends (unless the User has terminated the agreement before the end of the Test Period).

14.2 If the User wishes to terminate the Agreement, the User does so himself via the intended place on Websites or in the App. Alternatively, MediYoga Online must be notified via e-mail, or if MediYoga Online provides such a function, via the Website or in the App (see for contact information item 24 below). If MediYoga Online wishes to terminate the Agreement, MediYoga Online shall notify the User by e-mail, telephone or letter.

14.3 In the case of a Limited Subscription, e.g. time purchased via gift card, the Agreement automatically terminates when the period for which the User has paid in advance expires unless the User has previously paid for a new period.

Other
14.4 In the event of a change in fees or the Terms of Use, the right to terminate in accordance with clause 11 applies.

14.5 In addition to what is prescribed above, MediYoga Online has the right to terminate the Agreement to immediate termination and at the same time make the Service inaccessible to the User if:

(a) the user is late in payment by at least twenty (20) days (see section 6.7);
(b) The User has become insolvent or there is good reason to assume that the User may become insolvent;
(c) unauthorized use of the Service occurs or there is good reason to assume that such unauthorized use occurs;
(d) The User attempts to use a Test Period in violation of the Test Period Terms, or
(e) the User has otherwise committed a material breach of contract or repeated breach of contract.

14.6 If MediYoga Online terminates the Agreement in accordance with clause 14.5 (a) – (e) above, the User is not entitled to a refund of the fee paid to MediYoga Online.

15 Intellectual property rights
15.1 When signing an Agreement, MediYoga Online grants the User a non-exclusive, non-transferable and limited license to take part in the content from the Service. The User may only use the Service, and content in the Service, in accordance with the Agreement.

15.2 The material contained on the Website, in the App and in the content of the Service is owned by MediYoga Online or MediYoga Online’s licensor and is protected by copyright, trademark and/or other intellectual property rights. The User’s agreement with MediYoga Online does not imply that ownership or other intellectual property rights in the content of the Service, or in the Service, are in any way transferred to the User.

16 Security

16.1 The User may not act in any way that could cause the Service, the Website or the App to be deactivated, overloaded, damaged or impaired. The User may not infringe on another User’s use of the Service.

16.2 Users may not attempt to gain unauthorized access to networks, computer systems, content or information relating to the Website, the App or the Service Stone. Violation of this provision shall always be considered a material breach of contract, which may, among other things, result in termination with immediate effect (see also section 14).

17 Limitation of liability, disturbances and interruptions

17.1 Disruptions, interruptions or other errors in the Service must be reported to MediYoga Online as soon as possible. MediYoga Online is not responsible for errors in the Service that are beyond MediYoga Online’s control in accordance with clause 5.6 above or other errors due to the User using equipment that is not approved or due to negligence on the part of the User or others.

17.2 MediYoga Online is only responsible for disruptions, interruptions or other errors that can be attributed to circumstances for which MediYoga Online is responsible and which are not covered by section 17.1. For such disturbances, interruptions or other errors that have meant that the Service has been unusable for a continuous period of at least 24 hours, such Users who request it are entitled to a deduction from the fee for the Service. The amount that can be deducted must be calculated based on the duration of the error throughout the day from the time the User reported the error to MediYoga Online until the error has ceased. Deductions are made by crediting the next monthly fee. With regard to Time-limited Subscriptions, MediYoga Online may instead pay the corresponding amount to the User.

17.3 MediYoga Online, its subsidiaries, its employees, board members, partners or licensors are under no circumstances responsible for any loss or damage incurred by the User or anyone else through the use of the Website, the App or the Service.

18 Liability for compensation
The User agrees to indemnify and hold MediYoga Online, its subsidiaries, its employees, board members and licensors indemnified for loss, cost or claims caused by, or in connection with, the User’s breach of the Agreement, the User’s breach of applicable law or the User’s infringement of third rights of a party.

19 Transfer
MediYoga Online has the right, without the prior consent of the User, to transfer its rights, claims or obligations under the Agreement to another company within the same group or to a third party who can reasonably be expected to fulfil its obligations under the Agreement in a satisfactory manner. The user has the right to transfer their rights and obligations under the Agreement with the consent of MediYoga Online.

20 Links from the Website
The Website may include links to other websites provided by third parties. MediYoga Online has no control over and takes no responsibility whatsoever for such links or content on such websites. The user’s use of such websites is at his own risk.

21 Invalidity of provision
Should any provision of these Terms of Use or the Agreement, in general, be deemed impossible to enforce or invalidate, this shall not affect, invalidate or render enforcement of other provisions of the Agreement and the application of the Agreement or such provision shall be enforced to the extent permitted by mandatory legislation.

22 No consent
If MediYoga Online refrains from claiming performance of a right under the Agreement or refrains from acting against the User’s violation of the Agreement, this shall not be construed as an endorsement of the violation or future similar violations and shall not otherwise affect MediYoga Online’s rights under the Agreement.

23 Complaints and disputes
If the User for any reason is not satisfied with the Service, the User may contact MediYoga Online in accordance with what is stated in section 24 to complain about the Service.

Disputes in connection with the Agreement, the parties shall in the first instance try to resolve by agreement. If the parties cannot agree, the dispute will be decided in Swedish court with the application of Swedish law. The User, as a consumer, has the right to refer the dispute to the court where the User is domiciled. The user can also choose to first turn to the General Complaints Board for review of the dispute (www.arn.se/).

PERSONAL DATA POLICY (GDPR)
This Personal Data Policy, together with the Terms of Use, constitute the terms that apply to the Users’ agreement with MediYoga Online.

GDPR (General Data Protection Regulation) is a new regulation that applies throughout the EU and replaces the Swedish Personal Data Act (PUL) from 25 May 2018.

1. General

2 What personal data is processed?

8 Cookies
MediYoga Online uses so-called cookies on the Website to give the user access to certain functions and to obtain information about visits to the Website.

What are cookies?
A cookie is a small text file that is stored on the User’s computer and that contains information. There are two types of cookies. One type of cookie is a so-called permanent cookie that saves a file on the User’s computer until the file is deleted. The second type of cookie is called a session cookie which disappears when the user closes his browser.

What are cookies used for?
Session cookies are sent between the User’s computer and MediYoga Online’s server in order to keep track of information about the User, such as which username is used.

MediYoga Online uses permanent cookies, among other things, to make it easier for the User to use the Service, such as giving the User access to stored information, to obtain information about individual users’ use of the Service and recommend exercises and sessions that suit the User’s interests.

Anonymised information from permanent cookies is also used for statistical purposes such as to keep statistics about the use of the Website, to conduct surveys so that the Service is improved, to be able to determine which parts of the Service are most popular, to provide information to third parties so that appropriate advertising can be directed at the User, as well as to optimize the Website’s function.

How can the User opt-out of cookies?
